EDIT: No it's not that simple. The vote is still on Thursday. this is still preliminary horse trading. it looks a bit like the Council of Ministers is willing to drop the whole "3 strikes" part from the telecoms package right now, probably with the intention of bringing it back in another Directive. or maybe not. That would in fact be a partial if temporary victory.

However i got this very heartening response from one of the French campaigners on saying I found this depressing, so I pass it on :) It speaks to a lot of us digital types i think, and not just about filesharing laws.
"We're out of rationality here. So we may not win over the texts and
their contents. Anyway we're pinpointing such major democratic
dysfunction that any text can be written and voted by anyone powerful
enough.
What matters is our ideas, and the demonstration we make. We document
the whole process explicitly to demonstrate this, so people can see,
think, agree, and ultimately act.
Our strategic objective #1 is to raise consciousness about freedom in
that crucial paradigm change we're living.
Remember : we're right, we're many, we're younger than they are, we know
how to use the network.... and in the end we win. ;) "
